Procedure of a mandate

A mandate is divided into the three phases of preparation, notarization and execution of the deed, which I would like to briefly present to you here:

1. The preparation: making contact, producing the design, checking the design

You are welcome to contact us by e-mail, telephone or in person with a new request.
In advance, you are welcome to fill out the forms available for download here, send them to us by post or e-mail or hand them over to us in person, if available for your specific case. A preliminary meeting can then be arranged, if desired. In the area of inheritance, family and transfer law, such an appointment is generally advisable, as the conceivable arrangements are as varied as life itself. After making contact or having a preliminary discussion, we prepare a draft. A lot of legal work happens in the background during the drafting phase, so this step sometimes takes a certain amount of time. We will send you the finished draft for you to check and prepare for the notarization appointment. Please read the draft carefully before the notarization date and inform us of any additions or changes as soon as possible before the notarization date.

2. The notarization

If all parties involved agree with the draft, a notarization appointment can be arranged with the respective clerk. At the notarization appointment, the entire deed will be read aloud, unless it is purely a matter of notarizing signatures, such as in the case of an application for registration. The purpose of reading aloud is to subject all provisions of the contract to a final check, to receive explanations from the notary and to be able to ask any final questions.

3. The execution

Signing the finished deed is usually not the end of the story. Notarial deeds almost always have to be executed. This means that after notarization, further implementation steps are required, which we take care of for you. For example, in the case of a property purchase agreement, a number of approvals and certificates must be obtained from the authorities so that the transfer of ownership can take place in the land register. The notary will explain the steps to be taken after notarization during the notarization process. You will also be taken by the hand during the execution. When everything has been completed as planned, you will receive a message from us.
